Issues with Modern Theme – app view

Hi, I have just installed Modern Theme and I have some issues with it. When I'm scrolling a page, everything is ok (image2). But when I'm at the top of any page i have some free space between the top and the menu (image1). I have no idea where I can fix it. Seccond issue - when I click a user's photo to roll out the menu on the left, top menu suddenly dissapear (image3). Is there any posibillities to change it? Thanks!

Sorry, as of now the theme/header and all layouts work only with the default theme.
